No phone system is HIPAA compliant out of the box. A VoIP provider that routes patient calls, stores voicemails, or transcribes messages is a business associate of your practice, so compliance starts with a signed Business Associate Agreement and ends with how you configure the account. If you are unsure whether your practice is a covered entity at all, start with who HIPAA applies to.
A signed BAA
The vendor stores your call recordings, voicemails, faxes, and texts — that makes it a business associate. No BAA, no PHI on the system.
Encryption in transit and at rest
Calls (SRTP/TLS), voicemail files, transcripts, and fax images must be encrypted per the technical safeguards in 45 CFR §164.312.
Controlled voicemail features
Voicemail-to-email and auto-transcription copy PHI into inboxes. Each feature must be covered by the BAA or switched off.
Access controls and audit logs
Unique logins, role-based access to recordings, and logs showing who listened to what — the evidence OCR asks for first.
A live phone conversation itself is not stored, so the risk lives in everything the system keeps afterward: recordings, voicemail audio, transcripts, fax images, and text threads. That stored layer is ePHI and needs the same encryption safeguards as your EHR.

Is voicemail transcription a HIPAA risk?
Yes, and it is the most common gap we see in phone-system risk assessments. A patient leaves a message saying “calling about my biopsy results” — the system transcribes it, emails it, pushes it to three phones, and feeds it to an AI summary. One voicemail becomes five copies of ePHI, each stored somewhere different.
Voicemail-to-email
The audio file and transcript are emailed to staff. If that inbox is personal Gmail or an un-covered mail host, PHI just left your BAA.
Push notifications
Transcript previews on lock screens are visible to anyone holding the phone. Turn preview text off on every device that receives them.
AI summaries and analytics
Call summaries, sentiment scores, and searchable transcripts create new copies of PHI with their own retention clocks.
How the seven vendors handle it
- Nextiva removes the problem: voicemail transcription, voicemail-to-email, and mobile voicemail playback are disabled on HIPAA accounts.
- RingCentral keeps the feature on and lists AI transcription inside the BAA scope — acceptable, provided transcripts stay in RingCentral and not forwarded email.
- Google Voice sends transcripts to Gmail. Because Gmail is a covered service in the same Workspace BAA, that is fine only if the tenant is configured the way our Gmail HIPAA guide describes.
- Dialpad, 8x8, GoTo, Weave offer transcription; ask each in writing whether transcripts and AI summaries are inside the BAA and what the retention default is.
A transcript emailed to the wrong address is a reportable incident. If it happens, the breach notification clock starts the day you discover it, not the day you finish investigating.
What can a staff member legally say in a voicemail?
HHS answered this directly in FAQ 198: a provider may leave a message on an answering machine or with a family member, but must limit the information disclosed — for example, to the practice name and number and what is necessary to confirm an appointment or ask for a return call. The legal hook is the incidental-disclosure and family-member provisions at 45 CFR §164.510(b)(3), read together with the minimum necessary standard.

- "Your prescription is ready" — HHS names this as acceptable

Two rules that trip up good scripts
- Honor confidential-communication requests. Under 45 CFR §164.522(b) a patient can ask to be called only at work, or only by text. Flag it in the chart and in the phone system so no one leaves a message at home.
- A live person is not a voicemail. If a spouse or roommate answers, use professional judgment and disclose no more than the message above. Leaving results with whoever picks up is one of the most common HIPAA violations OCR sees from small practices.
What does a HIPAA-compliant phone system cost for a small practice?
For a five-seat office, expect roughly $50/mo (Google Voice Starter) to $250+/mo (Weave) before taxes and fees. The cheaper the seat, the more the compliance work shifts to you: the Google Voice price assumes someone configures the Workspace tenant correctly, while Weave's price bundles the healthcare workflow. Unlike secure messaging apps, none of these vendors charge extra for the BAA itself.

Pick by workflow first and BAA scope second. Every option below is compliant when configured correctly; the question is how much configuring you want to do.
Dental, optometry, or chiropractic office

The BAA scope trap: one phone system, four channels
Every modern VoIP seat ships with voice, voicemail, SMS, and fax. Buyers read “HIPAA compliant” on the pricing page and assume the BAA covers all four. In our reading of the seven agreements, only RingCentral and Weave state that plainly. The others cover the phone service and are vague or silent on SMS, which rides ordinary carrier networks — the same reason we keep a separate guide to HIPAA-compliant texting.
Fax is the mirror image. Nextiva turns vFAX off on HIPAA accounts and Dialpad sells it as an add-on, so a practice that assumed “the phones handle fax” ends up scanning to a personal email. If referrals and records requests still arrive by fax, budget for a dedicated HIPAA-compliant fax service or choose a plan tier that bundles it.
Our recommendation: list each channel as its own line in your risk assessment — voice, voicemail and transcripts, SMS, fax, recordings — and write next to each one which contract covers it. If the answer for any line is “none,” that channel does not carry PHI until it is. OCR's Risk Analysis Enforcement Initiative has made the missing line item, not the missing BAA, the finding that small practices keep getting cited for.
